UK Government position on EC Defence Directive infringement proceedings

Readers will recall that 4 member states were officially cited by the EC as having failed to transpose the Defence and Security Directive. In addition, infringement proceedings were commenced against other member states, including the UK.

This Department of Defence Explanatory Memorandum provides an interesting insight into the UK Government’s position. Perhaps not surprisingly, it asserts that full transposition occurred, albeit via the route of least resistance and minimal intervention.
