Swedish Competition Authority – Fines improve procurement behaviour

In a communication to the Swedish Government the Swedish Competition Authority has confirmed that the power to impose fines for non-compliance (available since 2010) has improved procurement behaviours amongst contracting authorities.

The SCA has taken 32 municipal authorities, county councils and government authorities to court seeking procurement fines since the more stringent rules under the Public Procurement Act entered into force in July 2010.

The SCA has a 100% success rate in cases where a ruling has been made, and stiff fines have been imposed.

The range of fines available is the equivalent of £900.00 to £900,000.00.
