5 June – “Bonda” Judgement – EU Penalties are Civil not Criminal

The facts of this long running case may concern the narrow issue of penalties for false declarations on returns seeking subsidies for farming activity, but the principle is universal.

The ECJ has confirmed that penalties of this nature imposed under directives do not necessarily give rise to criminal liability. This does not, however, prevent Member States from imposing criminal sanctions under domestic law…
