ECJ: Treatment of interest on repayment of aid – the sting in the tail!

Case C-564/10 (2012/C 151/12) – Germany v Pfeiffer & Langen KG

ECJ has given a preliminary ruling in this case which concerns the entitlement to recover interest on aid lawfully clawed back from the recipient.

The court held that the limitation period imposed by Article 3 of Council Regulation (EC, Euratom) No 2988/95 of 18 December 1995 for the recovery of aid wrongly received does not apply to the recovery of interest on that aid where and to the extent that the liability for interest arises under domestic law and not European law.
